DATA COLLECTION: (1) Student Information - The Service will in no event knowingly and directly ask any Student for any personally identifiable information either online or offline, nor will it require any such information for a Student to use or access the Service. However, the Service does allow Teachers (not Students) to input Student information as part of using the Service. It is up to the Teacher to register Students to give them access to the Service. The Teacher (or the School), and not Gradeweb, Inc., solely controls, defines and manages the collection, disclosure, communication, management and use of all data, including personal data on the Service.

(2) Teacher Information - Each Teacher using the Service must provide the following contact information to the Service: (a) their full name and email address; and (b) the name of the school district, the school, and the city, state, and zip code of the school. When the Teacher initially purchases membership in the Service, we also ask for the following information: billing address, city, state and phone number of the Teacher, and a credit card number. Once all the required information is entered, the Teacher selects a user account identification and a password that will enable the Teacher to log onto the Service and to enter or modify student information. The entry of all identifiable student personal data or assessment data is the Teacher's responsibility and Gradeweb, Inc. assumes no responsibility to enter, collect, or review any such data.

Gradeweb, Inc. will have access to personally identifiable data or information of any student, parent and/or teacher only on an "as needed" basis and solely to provide services to the User in connection with the Service. Gradeweb, Inc. will take commercially reasonable steps to keep such information confidential. Gradeweb, Inc. will not share any such personal information with any third party, except when such disclosure is necessary to: (a) comply with legal process; (b) enforce the TOS; (c) respond to claims that any content violates the rights of third-parties; or (d) protect the rights, property, or personal safety of Gradeweb, Inc., its users and the public.
